IPC Section 498-A: Misuse

Dedicated to the Victimised Indian Families, Who are falsely threatened & Blackmailed by the Indian Daughters-In-Law & her family members, and those Victimised families who are already falsely charged under the Section 498A. Its all about False charges of Dowry Law, Domestic Violence, Alimony, Marriage and Divorce. NOTE: All articles are my personal copyright. Indian Husbands is an Expression. Women go to the police with a complaint (may be false), but the system provides to record that as a criminal complaint and that data adds in to the National Statistics of Crime Against Women. When male goes with a genuine complaint the police at max can record a Non Cognizable offence against the women. That will never reflect in the statistics. Then how will one guage crime against men? Every 100 Suicides in India have 63 Males and 37 Females. Every 100 male suicides have 45 married males, and every 100 women suicides have 25 married Women. Married women suicides have default arrests of the inlaws under presumed dowry death. Married men suicides entitle wife for a 50% share in property. What kind of equality is this? Atrocities on Husbands Ignored, Bias Continues...

When a women suffers there is a correct concern but when a male suffers nobody is bothered. May be the facts are not allowed to be presented correctly.


On Zee 24 Tas on Men's Day, One Lady Lawyer argued that amendments cannot be made just because few men are suffering. (I will soon upload the movie) the fact remains that not just men but his entire family suffers which is been treated with a deaf ear (98% of the recorded complaints are false, Source NCRB, Supreme Court called it a Legal Terrorism).

Meanwhile One Ruchika's SUICIDE case has been able to give ammendments to the law, just because she was a girl and people are interested in pressurising the Government. I call ammendments as a welcome step, but my concerns on misuse check do not subside. I will soon discuss about them, once the Brouhaha is over and the matter is more stable.

But as of now what is concerning is the bias by the Media towards women and against men as NO ONE is concerned about the misuse. And nobody is talking about plugging the same. (I have a lot to talk).

If we look at suicides Year on Year they are Dominated By Males, but all are concerned about women. Even Todays TOI spoke about 15% Rise in Complaints against Husbands for Matrimonial Disputes quoting NCRB with biased headlines Crimes against women rise fastest.


But, in a clear bias, what was conveniently forgotten / eliminated / hidden / Overshadowed was the suicides by Indian Husbands YoY that are 'almost DOUBLE' than Wives. Here is the Data from the same NCRB. Check this out. And sadly nothing is being done despite our Call. Infact Males and Husbands are ridiculed as handful of victims who suffer.

Criminal and crimes do not have Gender. Hence the law too should not be gender biased. There has to be a Ministry for Men and National Commission for Men too. They deserve it as they are 82% of Tax Payers.

Some of the Many Bugs that remain to be fixed in 2010:
1. Suo Motu Punishment for Misuse of any Law attracting the same amount of Punishment as the Misused IPC Section, applicable for the entire mass who has committed misuse, irrespective of gender.
2. Introduction for a Machinery for recording of Complaints by Males against females as Cognizable offenses.
3. Domestic Violence Act be made Spouse Centric.
4. Fair Investigation before Arrests.
5. Mother and Sisters of Husbands Treated as Women and be protected from Wives under IPC to the likes of 498a.
6. Senior Citizens be also protected from Atrocities from Daughters and Daughters In Law.
7. Making Alimony law more Constructive.
8. Dowry Prohibition Law 3 & 4 made equally effective (Giving and Taking Dowry both should be treated as crime out of the books as well)
9. Execution of  Crpc 41 (a) in case of 498a instead of direct belated arrests on friday of innocent families of husband.
10. Suicide by Husband should be treated as a SOWRY death and the State should fight and investigate the matter fully with Wife and her relatives too.

 Its better to amend (DEBUG) rather than just talking like some LOUSY Politicians that "the laws are bound to be misused, they must stop being Baised and Stop pretending sleep."

Let there be 360 Degree Amendments on BUGS.

Well come jinish , we need more and more commondos like you , if we really want justice for indian husbands, Today only i mailed to a guy , who first time mail me for advice.
Our this fight against mindset, terrorism( legal) and to stop that target date is not fixed, the only one weapen we have to stop the terrorism is awareness , that is the key, long back i write one artcle, with the exprence of commonds, how they stop the terrorist activity in Punjab, now posted in kashmir. What you fell is injustice, for maximum people this it is claeed justiceand social service, abuse the men, making men's life miserable, the way terrorist group do in the same way those are working in the name of women right are exactly does waht a terrorist gorup does. In fornt of LAW they had made the marrage in india for men , itself is a crime, result evey year more than 56000 married men ending thier life and all those husabnds killers are moving freely in the society , means in last 10 years at least 5.6 lacks such husband killers are moving freely.
Presently waht we are doing making soften the feild, so when the reall diggin activity will be done it will be easy for our commondos to put the final nail or if you try to mnail in a hard feild, it is going to break or bend.. We have to first liberate the Indian men form their finciancial model thinkg , that they are a Free ATM machine, work hard for others and in return they do not have a small time to spend for them self, that has to be first changed. History wittness, such terroist activity can scare the people , but can't sustain , the same also there, earlier people used to lock up in jail for months together in 498a, we have enough people , at least today that had came down drasticatly, but our ultimate aim is to be achieved, the men well fare minsitry and society to accpet that the pain of a mother or sister is not less when they loss thier brother or son.

The Indian system is known for its knee jerk reactions. Be it Ruchika's case or some other bomb blast/ terrorist matter. Immediate steps are taken as if the Indian system and the powers that be are so very very sensitive and quick to react/ respond. All that happens then is poorly debated / discussed/ thought out (at least not with an informed set of people) rules/ laws/ procedures which more often than not spawn another monstrous malaise and social ill/ evil. The politician who comes to power seems to think it is his right to bring into place whatever changes (may be only cosmetic and mostly on whim and fancy) he wants / desires (for whatever reason- his vote bank or his strong bias) he can whene he is IN POWER. Little thought or discussion or debate especially of the informed variety goes in to these matters to come up with proper solutions or the ramifications of the change. In matters dealing with society or any other sensitive and important
matter any action that is taken must be after informed debate and discussion going into the whole gamut of the issues and all possible results. So then we now keep having: Half baked solutions/ ideas giving rise to another set of terrible problems. Sec 498A or the DV act fall in this category clearly. It is perfectly all right to ensure delivery of justice to the really harrased or oppressed or exploited section but if you change the law in such a way (like with 498A or DV act laws brought in keeping only a certain section of woman and certain section of man in the country) and make it apllicable universally throughout the length and breadth of the land it is too much of foolishness, I cannot find words to express the utter monstrous foolishness of such an act. This same law is only equipping many unscruplous women with the power to exploit, destroy and thereby blackmail (with the support of the state and system). A whole ugly breed
of criminalised system is spawned and encouraged to thrive exploting to the hilt and capitalizing on these lopsided laws. In the final analysis Laws must be what : fair , balanced and just. And the courts must see that justice is done. No innocent should be made to suffer in any civilised society and the law should strive to ensure that. Empowering a whole class of people (whether based on gender/ religion/ caste- immaterial) with such and similar clearly biased laws (rather than finding a just social political solution) is a dangerous and foolish short cut act. It is not a solution at all in fact. But our System so easily embraces such dramatic announcements and changes. I dont't understand why. Is it the way we as a group of people are? Generally speaking tht is: insincere, superficial, lacking in depth of thinking, prone to cut corners and take short cuts given the smallest chance : chalta hai/ baap ka kya jaata hai attitude) . This sort of
solution that we take (498A or DV act) is like deciding to give hand grenades and explosives to the 'weaker sections' of the society so that they are not exploited by the 'stronger sections'. Instead of providing justice and equality and security by the quality of governance/ administration. Instead of spreading awareness and education. Instead of forming institutions and supporting them for desired social and atiitudinal changes. Instead of that imagine if the government decides to prevent atrocities on whichever class / category of weaker section by just handing over to them explosives/ grenadesin its typical knee jerk solution/ response way, what havoc it will cause to the whole of the country, its society.

Happy New Year. We must make concerted efforts to bringabout necessary amendments to section 498a such that atrocities on husbands are adequately taken care of. 498a in the first place should be made bailable and non-cognisable. Hope the law makers wake up to this present stupid provision in IPC

Apart from making efforts to get the laws changed we must also try to create enough social awareness against its misuse. At the least it would ensure that the society does not condone such heinous acts. The unscrupulous women should not be allowed to get re-married again easily. We should make it impossible by creating awareness. Let these women and their family not be allowed to destroy another person's life. It would to some extent also help in preventing misuse of this law. Till the lawmakers awaken we need to search for alternatives to tackle this menace.

One more victim of misuse / abuse of 498, who is counting days, and praying all the time to finish the counting as soon as possible. The hurt, The pain, The suffering can only and only be felt by the person charged under 498. It feels great to read about this movement called MASHAAL, I stay in Hyderabad, and so feel I may not be benefitted by it, anyway it matters least for a person who is guest of little time.

I would like to personify the fact that, there are so many husbands, who still lead a married life undergoing an eternal torture and mental agony due to the unceasing nagging, dures, threat, insult,blackmailing etc., by their so called betteroff. They are unable to raise the voice due to the fear of reactions. Your blog really encourages to express the views of such underprivilaged. I wish the best in your endevour.

All the harassed husbunds should get together,volunteer to stage a peaceful protest in front of / near the residence of the (false) 498a wives.Fear of denting the reputation in the neighbourhood should teach a lesson or two to the unscruplous wife who is misusing the dv/498a for monetory gains

It would be very helpful if you write a note elaborately on the misuse of this law and send the same to all Members of Parliament and Union Central Ministers including President of India, Prime Minister, Chief Justice of India, requesting them to look into the matter very seriously. You should request them to bring out a Ministry for Men or an act for curbing the atrocities against Husbands. Afterall, males are also major percentage of voters in India.

Hi,

I am one of them who is being threatened by my wife, her parents and relatives in filing dowry case. They are taking this as a means to separate me from my mother. I am staying in Dubai and my wife says that my mother should not come and stay with us. I agree that atrocities against women should be punished but at the same time atrocities against men by women should also be punished.
